1. Acceptance

By accessing or using T8X at t8x.net, you accept these Terms of Use in full. Continued use of T8X following any update to these terms constitutes ongoing acceptance of the terms in force at the time of use.

2. Service Description

T8X is a browser-based, multi-pane text workspace and clipboard utility provided as a general-purpose convenience tool for personal and professional text management. T8X operates entirely within your browser using your browser's local storage.

3. As-Is Basis

T8X is provided on an "as is", "where is", and "as available" basis, with all faults, errors, defects, and limitations, whether known or unknown. No warranty of any kind, express or implied, is made regarding T8X's fitness for any particular purpose, merchantability, accuracy, reliability, availability, or uninterrupted operation.

4. Not for Mission-Critical Use

T8X is expressly unsuitable for mission-critical, life-critical, safety-critical, or legally consequential work. Users must not rely on T8X as the sole repository for data of significant consequence. Browser local storage is subject to clearing, expiration, corruption, and device failure. Users bear sole responsibility for maintaining independent backups of any content they consider important.

All content entered into T8X remains the sole property and sole responsibility of the user. T8X claims no ownership over user-generated content. Users bear full responsibility for the legality, accuracy, and appropriateness of all content stored or processed using T8X. Given the local-storage architecture of T8X, users are solely responsible for the security of their own device and browser environment.

7. Disclaimer of Warranties

To the fullest extent permitted by applicable law, T8X and its operators disclaim all warranties, express or implied, including without limitation all warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. T8X makes no warranty that the service will meet your requirements, operate without interruption, remain secure or error-free, preserve or make recoverable any data stored in browser local storage, or produce results that are accurate or reliable. The entire risk as to the quality and performance of T8X rests with you.

8. Limitation of Liability

To the maximum extent permitted by applicable law, T8X and its operators shall bear no liability for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of T8X, including without limitation loss of data, loss of profits, loss of business opportunity, or any other commercial or personal loss, regardless of whether T8X has been advised of the possibility of such damages.

The total aggregate liability of T8X and its operators for any claim arising out of or relating to these terms or the use of T8X shall not exceed the amount paid by you for the service in the twelve months preceding the claim. Where T8X is provided at no charge, total aggregate liability shall not exceed one Euro.

9. Indemnification

You agree to indemnify, defend, and hold harmless T8X, its operators, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable legal fees, arising out of or relating to your use of T8X, your violation of these Terms of Use, your violation of any applicable law or regulation, or your infringement of any rights of any third party.

10. Intellectual Property

All code, design, interface, architecture, branding, and content comprising T8X, excluding user-generated content, remains the intellectual property of T8X and its operators. Users receive a limited, non-exclusive, non-transferable, revocable license to use T8X solely for lawful purposes in accordance with these terms. No rights are transferred beyond those expressly stated here.

11. Third-Party Resources

T8X may incorporate stylesheets, fonts, scripts, or other resources served by third-party providers. T8X makes no representations regarding the availability, performance, or privacy practices of third-party resource providers and bears no liability for any third-party service failure or conduct.

12. Modifications to Service and Terms

T8X reserves the right to modify, suspend, or discontinue the service at any time, with or without notice, and without liability of any kind. T8X reserves the right to update these Terms of Use at any time. Continued use of T8X following any modification constitutes acceptance of the revised terms.

13. Severability

If any provision of these Terms of Use is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed entirely. All remaining provisions shall continue in full force and effect.

14. No Waiver

Failure by T8X to enforce any provision of these Terms of Use on any occasion shall not constitute a waiver of the right to enforce that provision or any other provision on any future occasion.

15. Governing Language

These Terms of Use are drafted in English. T8X may make translated versions available as a courtesy to users in other languages. In the event of any inconsistency or conflict between the English version and any translated version, the English version shall prevail and govern in all respects.
